SOE mistake = fraudulent use of my bank account

Foremost this is not a troll trying to get people to dislike/hate SOE or any of its games.

This is a issue I have recently had to deal with and this threads only purpose is any help on something I could do to get the money SOE has unlawfully taken from my bank account or at least find a way to prove what really happened.

 

In early January I opened up Vangaurd. I tried the trial and upgraded for the hell of it. I played into mid febuary and do to a few diffrent things I turned off the account and deleted it from my computer. I have NO hate for the game.  Just to make that clear.

In the beggining of April I bought the box version of EQ2 Shadow Oddesy and after a few weeks my wife joined as well. We played for a few months (love the game actually) and turned them off by the beggining of August(mine) and also midway through(hers). We left with plans of resubbing again in the future.

Well on this past August  28th $14.99 was taken from our account that my wife noticed. We immediatly thought this was for one of our EQ2 accounts which should have been off. We call and they confirm that EQ2 is indeed off but our '3rd' account is still running.

She immediatly asked what the hell he was talking about. He said it was for Vangaurd and it has been on since April 28th. He also said it came from 'our' IP address so that dismissed the possibility of a hacker. Not to mention how stupid the idea of a hacker getting into my system and resubbing me to Vangaurd instead of cleaning out our bank account or w/e else could come of it.

Well, he even confirmed that I did in fact turn it off in Feb but according to 'them' I turned it back on myself on April 28th and maybe I just forgot I did it or maybe it was 'accidental' on my part. The idea of me sleepwalking to my computer, somehow getting into a game that had been deleted from my computer and reactivating my account just sounds immpossible to me. Obviously I am not lying about it. Maybe I can't prove that to them but I can sure vouche that resubbing to a mmo is something I am not going to lie about or forget about. 

I do not check our bank transactions. Frankly, I do not like to deal with alot of the 'paperwork' so to speak in the relationship and I admitt it is shortsight on my wife and myself that this went unnoticed for 5 month totaling to $74.95  being taken in all. And I am totally aware that how long it went on is most likely verification on their end that we just want 'free money' and are trying to scam them. But i can assure anyone reading this that that is not the case.

Well we are just being told over and over that there is a no refund policy and that it says so in the user agreement. I just do not see how that is fair considering this is a fraudulent matter.

I imagine contacting a lawyer would just cost more money, be a laughable case and in the end I really have no idea how I am supposed to prove this anyway since all the information is on SOE's end. Of course I considered the BBB but really.........what would that solve anyway?

We had SOE ban the use of our credit card number from their system but I am at a loss of any way I could prove that this was a fraudulent case.

Any advice or feedback in general is appreciated. Just please keep on topic since I am not trying to get anyone to 'love' or 'hate' anything. I just want to make sense of this considering I really LOVED EQ2 (lvl 75 wiz,50sk,45warden,35assasin,12nec yea i think i liked it some) but feeling like SOE jusr literally robbed me kinda makes the idea of resubbing kinda lame.

    If it's simply a credit card, you can file for removal of the charges for fraud; however, if it was a debit card, in short, your screwed.

    Never, ever use your debit card online.

    Recovery of funds via use of debit card is very difficult. Some banks even state in your account agreement that they will not refund more than $50 of lost funds - that is if the issue is reported within 48 hours.

    Sorry, but I think you are going to have to eat it. You might want to cancel that card and have a new one reissued.

    Unless ofcourse your bank is super awesome, then they will do so even with debit cards.

  • You did not check your statements for 5 months?

    Where would you be now if a real thief had gotten the use of your card number and charged off hundreds or thousands?

    This is real common, happens alot with SOE.

    Whenever you cancel your account go into their sytem and delete your credit/debit card information.

    That way their computerized billing system has nothing to put the charge through against.

    In addition, when someone hacks SOE's computerized billing system, they will not get your credit/debit card information.

    Just as an aside, never, never, never use a debit card. If the seller's system is compromised your bank account could very well get cleaned out. It will take the bank awhile to investigate, meanwhile you and your family will be living on Raman noodles, and syphoning gas out of the neighbors lawnmower at night to get to work in the morning.
