Whiting wins?

 I am not the best legal mind, so let's discuss this here. First, the court document, which is public record, can be found here.

 

It looks as though the court is denying the attempt to remove Whiting and further investigating whether all those harassment charges were legal stall tactics.

 

Also, I noted that the motion to have an emergency hearing regarding "The lockout and removal of the game source codes and assets and equipment" is ordered as DENIED on the grounds that the motion came after the initial hearing and "The Motions cite absolutely no legal rule, statute, or authority to grant the requested relief."

 

It sounds like to me that Whiting wins and CME lost access to all SGW assets. Am I reading this right? If so, consider SGW finally dead.

    I think you have it backwards. It was Whiting's (Board of Directors) motion that was denied.  He was asking the court to reappoint Whiting as Chairman of the Board or whatever, and quash the restraining order keeping Whiting out of the corporate offices. Because he did not cite any legal authority to do what he was asking for in the motion.  Sounds like he needs a better lawyer.

    In reading some of the earlier minute entries it appears that the court appointed Edward Burr as receiver for CMG. So that would mean that Deering is removing the equipment source code etc.

    What a mess.

    I'm not a fan although i seen the movie (doesn that count) and it does seem interesting although it doesnt sound healthy.

    Okay. Walk me through this. I do not know law.

    The document says:

    IT IS ORDERED denying The Board’s Motion to Re-Urge the Motion for Relief from Plaintiff’s Corporate Takeover and “Removal” of Director Whiting; and Request for Emergency Hearing. 

    IT IS FURTHER ORDERED denying The Board’s Second Request for Emergency Hearing.

    The Board is Whiting (the Defendant)? He is asking for Relief from Plaintiff's Corporate Takeover (Deering's removal of him)? And McGill (one of the co-defendants) asked for an Emergency Hearing to prevent the machines from being carted off? And all of that was DENIED.

    If you have me straight now, that is GOOD news for once. Even if it is only moderately good news. If I have it right now, I wish I could change the thread name.

    Well it's a big mess and all I see is Whiting pulling the same stunt with CME and Deering as he did in the past with another company and Tim Jenson. I can't remember the name of the company now and can't be bothered to look it up but think it was a securities scam. Whiting was heading for the chop and got Tim Jenson to take the fall for him which is what I see here. Getting himself removed legaly so that he has no culpability when it all goes down the drain and Deering will take the fall for him. Atleast that is what I believe the plan is going on his track record.

    It doesn't really matter for those waiting for SGW now as there is no way they can recover from this horrible mess and put out SGW. I see SGR going poof sometime this summer too.

    As for the company they're swimming in mounting debts and litigation with past employees that are still waiting to be paid lining up at the court house to pick what's left from the CME carcass. The tax man is owed millions and where did the $40 million dollars in investment go?

    The only people that don't believe that are the 5 Fanori still holding out, though I'm not certain what they're holding out for? Khestral will soon be gone as will TKK snow but I'm certain they can put some positive spin on that right? "Now they can concentrate on SGW!", "Now they have more money to spend on development and it could be out this christmas!" yeah whatever! There's more chance of Elvis Presley announcing he's still alive and buying out Whiting and making SGW because he's a big SG fan and avid MMORPGer!

    As opposed to IPs like Star Trek and Star Wars, which have also done poorly on the MMO front (at least SWG was good at one time).

    It seems like the sci-fi genre can't get a break with good MMOs since EvE.
