I doubt you will get a refund, most likely the problem is on your end not theirs. Is launch did people expect the game to be running like a dream from day 1.
That tired excuse has just about been run into the ground for this game by now.
Honestly, this game will probably end up on the list of reasons why you don't pre-order for early access to a game, its been an unmitigated disaster, at least for the players in the US, though how come the EU servers are so different from the US servers is more than a little strange.
You can also add every mmo to that list since 2004, don't know how well they launched before then.
Zenimax seems to be open to providing refunds as long as you purchased the game directly from them. If the OP is having trouble getting a refund from them, it is likely due to a third party purchase.

I too requested a refund and looks like i might get it. However, I bought straight from Zenimax and so far they have been speedy with customer service responses, even if it's outsourced and form letters. I did a small bit of research and 3rd parties are going to make a refund really tough to get. The game worked better for some than others, so arguing over bugs and how rough of a launch is too rough is getting pointless. I think the first 7 days of these types of games should offer refunds if bought from the developers themselves and not a 3rd party. But many of us are certainly guilty of not doing our homework before we purchase something subscription based and high priced. I did not preorder myself, but I should have waited a month or so before a purchase, which was most of the advice on mmorpg.com forums. See, these forums matter

There really does need to be some kind of 'test' for people before they are allowed to buy computers and/or software/games.
