In the unlikely event that this did go to some kind of trial, the judge would probably issue some kind of media gag order which would prevent all parties, and especially Derek Smart, from discussing the subject on the net or anywhere else for the duration of the proceedings. That would make his head explode, wouldn't it? A silent Derek Smart that couldn't use his poisonous tongue to stoke the fires of the witch hunt.
Sad part about all this is I wish people would ask CR to show them the basic game and allow them to login to it to see what he has created in all this time. Not the modules but the actual basic game design. We all know the first thing they need to create for the game is the engine, after this long he should have a basic character screen setup and a world you can log into.

Yeah I agree as a gamer I don't care how they spend their money tbh... I care about how much of the game is workable now and how close it is to basic playable version.
Many of the rumors, conspiracies sand arguments could've easily been resolved have they release base game that is playable but lacking stretch goal features, which they can add over time instead of trying to release it as one motherload.
I suspect many of the opinions are actually in the middle, the scaled and sequenced release of the game would've easily sway people towards favourable opinion (like Elite: Dangerous did and is doing) .
So, I finally finished reading the blog and I am gritting my teeth over how much of a bastard this guy is. It is very easy to dislike this man. He has the unmitigated gal to state "I have never advocated nor campaigned for this product to fail".
Question: does anybody on this forum who has read Derek's blog actually still believe that he wants Star Citizen to succeed? Please come forward and identity yourself so that I know who to discount completely in future discussions.
He goes on to detail exactly what will be shown at Citizen Con next weekend, basically spoiling it for everyone if he has a source that's feeding him that information. This is not a good a person.
I like the "I have never advocated nor campaigned for this product to fail" and then reading tweets he's sending to random game journalists telling them to look into the project/drama.
Sadly, if the Escapist were smart (and hopefully they are) they will cut any/all ties to him. Right now they are nothing more than a flak jacket for him. If they end up getting smacked in court you can bet he will distance himself from them.
He's a strange one though - pointing out others the wrongs of others while being guilty of the same thing he is 'standing up against', like the alcoholic chain smoking parent telling their kids not to drink/smoke.
But oh well, it's an interesting ride, and a bit more entertaining than fall TV so far.
There are 3 types of people in the world. 1.) Those who make things happen 2.) Those who watch things happen 3.) And those who wonder "What the %#*& just happened?!"
my guess is tht he wants to intimidate em to cut a deal 2 settle this outta court hasnt he got plans 2 start a new software studio? such things costs $$$$$ n he might b short on tht

I was thinking more like he's gonna do a kickstarter when star citizen finally releases. people will inevitably hate the game. either way he's after the money.
..."Then, in what can only be described as sheer madness, they lost their minds and made it personal. They canceled my backer account, and refunded me. Without my requesting it."...
Companies can and do 'fire customers'. Please forgive me, but I'll give you an example of when I first encountered this. I was working as phone tech support for [Company], a software company. I had a caller, who kept using profanity. I politely asked him, "I'm sorry sir, but please do not use profanity on this call.". I was in the military for 8 years, and I can cuss just as much as anyone else, and if I hear it enough, I do it without even thinking. That does not project a professional appearance, so though the cursing doesn't bother me, it's best for me to avoid it at work. We continued, and he began directing personal insults at me. I warned him, "Sir, please do not insult our technicians or the call will be terminated.". I actually had to warn him 3 times, which is 2 or 3 more than most techs will put up with. He did it a fourth time which earned him, "Sir, verbally abusing our technicians is not allowed, please remember that next time you contact us for help, thank you for calling, goodbye." and hung up on him. Being more than a little upset, I got up and started to walk to the break room to get a soda and calm down. My supervisor came out of his cube and called me over and said he'd been listening in on that call. I figured I was toast, after all, what other occasions do supervisors ever want to talk to you? He sat me down, pulled out some papers, and told me to read and sign them. I figured I was screwed. Then I read them. Basically the supervisor was terminating the customer relationship with that guy for abusing technicians. The guy was labeled toxic, all products from [Company] he'd purchased were being refunded, and he was required to uninstall them and never buy or use any of them ever again. A special note was also being inserted on his file to pop up anytime he called us to highlight that fact. I was shocked. He wasn't the last I know of to receive that treatment, he was just the first I'd encountered. Companies can and will 'fire customers' that they feel are toxic. You wanna guess what RSI thinks of DS?

A company I worked for had two terms that confused me for the first few weeks I worked there.
Fired - When the company terminated a relationship with a customer due to the customer abusing privileges or staff or for toxic behavior.
Promoted - When an employee was let go (also referred to as 'promoted to customer')
Now after finally getting a handle on the jargon, I almost had a stroke when a supervisor one day congratulated me on my promotion. Come to find out that promotion also meant promotion when I was offered a position in a new department a week later.
Was kind of funny when the HR rep told me about the position and then questioned me about a couple of calls they received, from HR depts of companies I had applied for thinking I had been fired...
So yes, companies can and do terminate relationships with customers, especially when they are toxic.
Also, HR reps will laugh at your expense

Yep. Companies refuse to work with customers all the time, no matter the type of company. I work for an online university. We had a student who kept insisting on going off on crazy ass rants babbling about things that had absolutely nothing to do with us, insulting people, causing drama, just basically being a crazy bitch. After a few weeks of it, and doing it to multiple departments, she was dismissed from the university.
Youve got to be pretty damn bad to get dismissed from an online university for being an asshole to people, but people actually are that bad. Employees don't need to deal with your shit just because you're a paying "customer" who wants to act like a prick for no good reason.
Shame Derek Smart didn't realize this before he got into this situation. Now he is just making himself look like more of a clown than he already did.

By the articulate I thought they said they had no connections to DS, seems like people just do not want to accept that. I know VR doesn't accept it and his cronies sure keep that feeling alive even if not true.

Lost my mind, now trying to lose yours...
