Vanguard has pvp in the form of duels and the arena. Also very limited instance (one example I can think of). Definitely comes close to your requirements. I would say it's worth a look for you.
Vanguard - i bought the box version fo Vanguard and really enjoyed the PvE... but the game was just broken and now it's empty.
Darkfall Online - The character actions, movements, and spells are so crappily done I just can't bring myself to play this game. This kills immersion for me.

Fallen Earth has very little instancing. They do have battlegrounds, but there are also open PvP zones. Very few quests are instanced and even the instances just give you a popup window, i.e. no loading screen.
But I'm afraid it might be only a step above Darkfall for animations and movements. The graphic texture quality is a bit higher rez. The guns look fine to me, I always thought the melee looked a little like fat jedi kid.

Fallen Earth is crap
Only thing that comes to mind is DAOC, or EQ-PvP servers.
EQII's pvp server has a "decent" population as well, but the 60% of the game being Instanced may turn you off. I didn't realize just HOW much of EQII was actually instanced until now having to think about it :'(.

Other than the games already mentioned, I'm thinking Lineage 2 or maybe Aion. I know there's plenty of PVP, I don't know about instancing.

Aion does have some instancing, though it's only in the form of PvE dungeons. All the PvP content and more than half of the PvE content is open world. At least that was the case when I played it a while back, don't know if that has changed much since. Unless you decide to spend a lot of time grinding for the rare drops from dungeon bosses you probably won't spend much time in instances.
Although I haven't played it, you should check out Lineage 2 as it seems to be what you're looking for. I've heard that it's going F2P sometime soon.
Aion is a possibility but I really don't wanna pay $30 for it.
DAOC is my favorite MMO of all time. I wish it wasn't so old and/or there was a worthy sequel.
You dont want to pay $30 for aion specifically or you dont want to pay $30 at all. I think that little bit will limit your choices immensly if its the latter.

Actually I already bought Aion when it was released, i thought the expansion was $30 but i guess it's free. I might try it out but reading the forums it seems the open world pvp has shifted away with the removal of rifting or something?
I've been playing Dragon Nest and Path of Exile, both heavily instanced but they are fun for now so /shrug

Darkfall is by far the funnest one. Its now polished enough that with a nice computer you can leave shadows on and turn your graphics up. With small scale PVP you do not have to see spell particles much. Darkfall 2.0 is coming out with revamp of what you dislike so keep an eye on it.

Vanguard is one of the best mmorpgs out there and it has a fully open world. You should play this one, if you are looking for non-instanced game!

No one is playing on the EU server, so you will find both EU/US player on the other server. The community is not big and not too small. It is healthy and is growing, while it stays stable. Give it one more try!

EVE Online has 0 Instancing.
Vanguard is one of the best mmorpgs out there and it has a fully open world. You should play this one, if you are looking for non-instanced game!
