Let's imagine (not saying this is the case with SC) you pledge for a game and nothing is delivered. The money gets spent, meaning you can't be refunded anymore. The company says they tried to deliver - and there is currently no legal obligation in the Kickstarter terms that would guaratnee you compensation.
It seems to me the only viable action is creating legislation protecting future crowdfunding donators?
What you just defined is a ponzei scheme, not saying thats whats happening, but it wouldnt require new legislation if it plays out as you defined. in those case assests are seized (even in some cases assets not directly linked to the scheme) and distributed to whatever victim class the feds define.

Aside from that, no attorney would have let Chris post that rant given the serious liability issues he just exposed the company and project to. KOTAKU 'Journalists' even admitted this but said they wouldnt print it because "drama blah blah blah"
Yet they sure as hell helped the SC hype train by running articles about records breaking, new ship sales and bestest game ever- They didnt investigate, withheld the information and then helped SC to crowdfund even more money from their userbase. Now they have the balls to come out and admit they've known this all along- yet for years were part of the hype train that made this project into what it is.
Now, if I owned a website or gaming publication I would tread very carefully as to what side of History you want to be on now. Go down with this ship, and those hype reports WILL be thrown in your face everytime you try to hype something else (I promise) . You're either no better than an advertiser or nintendo power magazine- Or you understand we are now in an industry bigger than hollywood asking YOUR readers to fund this shit. That some of this(alot of this) bullshit rests squarely on your shoulders.
The wheat is being separated from the chaff right now and this will effect the future for gaming websites and the gaming press forevermore. This will ripple across the lake in ways that I cannot even imagine, but ripple it will.

Not really. I've been on both sides of that fence. When the journalist comes around, employees either want to look busy or want to look like rockstars. The journalists usually are there to speak to specific people (often on specific topics), so it's not like they are wandering the office asking anything of everyone.
It's funny because you can tell the difference between the offices - and even individual stations - where people actually have fun and the ones where stuff is just set up to give the vibe "hey, look, we have fun!"
That said, after you've been on enough office tours, you can usually tell which is which, so an experienced journalist will probably be able to see through the smoke screen if there is one.

If you haven't watched it yet, go take a look as she explains how she came about the story, and why she ran with it. It all started with my blogs. The SAME blogs that EVERY media outlet has been reading and reporting on since July.

Already the tide is turning and we are just getting started. So much to come... Very 'Smart' people on both sides, but one side is advancing right now while the other is losing ground. An animal is most dangerous when its cornered. I imagine a tough and dirty fight is just getting started.
Nobody owes an apology though unless they misrepresented themselves or knowingly lied- And we wont get that apology. If it turns out i'm dead wrong on everything I would apologize but I dont think I 'have to' I'm doing whats in my heart- I think thats what everyone is doing regardless of position. Its being able to see when you're wrong and admit it to yourself that really counts.
There is no random answer. There is nothing to verify to anyone. The person who tried that - without any plausible reason - found out in court that not everything you read on the Internet is true. If I come to you for a job, and I present to you my resume, feel free to check my references and my academic credentials.
As I've stated for the public record (because I knew that once this SC issue goes to court that's the first thing they will attack. Like they have done in their legal letters, Chris's rant etc) I have two. Not one, two.

And there is a reason why Chris didn't go there in his rant. Nor did Ortwin in his letter. Had they even attempted it, they'd just increase their liability. I think they probably know (maybe from past legal action, I dunno) this, and don't want to give me any easy win.
And legal pointed out to me today that Chris's comment about Sandra having five degrees, definitely sounds like hyperbole because he knew that he couldn't directly state anything about my degrees without running into trouble, but he couldn't let an easy jab slip past.
Game developers are just human beings who happen to make games for a living.

He brought malfeasance to light. What is so repugnant about that? Speaking of repugnant, what say you about a company that, if Smart's prediction comes to fruition in 90 days, will go down in gaming history as the gaming company that scammed nearly one million people out of nearly 100 MILLION dollars. I find it interesting that you would have a problem against Smart for having brought this scam to the surface, and no animosity at all toward a company that ripped off so many people off of their hard earned money.
And has a right to do some gloating (even now)- After the shit thats been hurled his way just in the past few months because he staked everything on this with little to gain and a ton to lose.

I don't think the what bothers so much(I find it somewhat admirable really) it's the how that people are un comfortable with.
-He deserves it and itll be a much better "investment/donation/fire place throw" of my money than a $900 SC ship .
