Last week, a flurry of news items flew out across the internet with giddy Zelda fans eagerly rushing to the fan-made site that recreated The Legend of Zelda. The game could be played across any platform with browser access and the fandom rejoiced.

    What I don't understand is why didn't they contact Nintendo BEFORE they did work and see if they would support some version of their project?

    For the most part Nintendo will not even review it and tell you to consult with a legal team. Two guys doing this as a passion project probably do not have much access to that type of legal counsel.

    It all comes down to making money. I did not visit the site that hosted this but I know that if there were was no advertising, that no one that played the game was charged a fee and that the people that posted the game made no profit from it that Nintendo had no legal claim in the instance. It's like making fan art and posting it on the internet. If you're not making money off of it then you're not infringing on copyright and there's no reason for the holder to sue you. It's either Fair Use, Freedom of Speech or both.
    Now if this game actually were generating money then Nintendo had every right to ask for it to be taken down.

    Freedom of Speech?  Do you even know what that is?  Freedom of speech is the right to communicate one's opinions and ideas without fear of government retaliation or censorship.

    Fair Use = In its most general sense, a fair use is any copying of copyrighted material done for a limited and “transformative” purpose, such as to comment upon, criticize, or parody a copyrighted work. Such uses can be done without permission from the copyright owner.

    Not putting a game owned by someone else out of the internet.

    you don't need legal counsel to contact a company and see if the will allow x, y and z. 

    All they need to do is contact the company, be referred to their lawyers. If they lawyers are willing to see their proposal then they submit it.

    Then the lawyers might have some papers for them to sign if they agree. the two people could then have a lawyer look at it for $100 to $200 dollars or so just to make sure they understand everything in the document.

    I do this with publishers if I want to set a poem to music. I contact them, if they give permission they send me a document and if I agree to the terms I sign it and send it back. 

    It's a small amount of due diligence to ensure that one's work isn't done in vain.

    What they should have done was change some of the text and graphics in such a way as to make it appear to be a parody. Then it would have been covered under fair use.

    Because they know Nintendo doesn't work this way. Nintendo is insanely protective of its IP. They would never grant permission.
    I find this funny, considering how incredibly batshit insane the IP has become over the years.  Have you ever tried to piece the Zelda timeline together??  Haha  :p

    Because now that they've leeched off of Ninetendo IP they've made something that has gotten half a million views.

    Got themselves in front of a few people that could potentially hire them or similar.

    Got attention for a project that was probably mostly useless(I know I wouldn't be here otherwise).

    Next time they're in an interview they can shove all of that on to the table. 

    And/Or maybe shove their social profile in front of people to sell "The Bit Box".

    When being such big fans of Zelda it's just outright stupid to make this without consent from Nintendo as anyone being even remotely interested in and knowledgeable about Nintendo also is very aware of the fact that they tolerate absolutely NO kinds of fanmade tributes or Let's Plays put on the internet /golfclap

    Nintendo has always been prissy about this kind of thing.  It doesn't even matter to them if it's tribute for fun and earns no money or even if it bring interest towards nintendo themselves in a good way.

    Can't help but think it's a culture thing, their IP so they must have control  etc etc..

    yeah....so I make something...doing the hard work...then you steal it and I do not make a return on my idea cause you copied me for cheaper.   I do not know what world you live in, but that is not what gets people interested in inventing things.  It makes people search around for stuff to steal.
