The scammed party could take him to a court. Even if scamming is allowed in EVE, it's not allowed in real money, and the court would likely judge that it wasn't part of the game thus normal contract law applies.
That doesn't mean a court would necessarily order the scammer to pay anything. If a contract is morally and ethically questionable enough, a court has the option to decide that officials take no action to enforce it.
its not about the people who play the game, its purely in game, its questionable, sure, it also makes the guy look weak that he has to use real money to get what he wants instead of having friends/allies.

I was in a mercenary corporation for about a year and we were paid for every ship we killed from another alliance. I had a bounty placed on myself personally back in 2007 when I was solo raiding Geminate and wrecking Fang, Roadkill, Smash and the fledgling Atlas alliance. Boy did they hate me and my pre-nerfed Vagabond.
Also, World War Bee was entirely financed by one player with obscene amounts of in-game money. In fact, he financed multiple alliances and they named themselves the Moneybadger Coalition since they were being paid to fight. This was the coalition that eradicated most of Goonswarm from their territory in the space of a couple months.

Proving karma can be a b!tch, CCP shut down his gambling operation, seized everyone's ISK invested in the site and banned him and others. Reason: apparently can prove he was RMTing.
