On the bright side, I was right that this was a cash grab. Go me!

In all seriousness though, there's a reason people have been saying when you 'back' these projects, you might as well think of it as 'donating' and move on or.....don't do it at all (I know that's a crazy idea but sometimes it works). I understand that people want to back their 'dream mmo' or whatever and some have come to fruition (Path of Exile/Albion are still going strong), but the failures greatly outweigh the successes.

They produced nothing of worth. I love where he says they really expected to produce a playable game for 900k when $8M wasn’t close to enough.

IMHO Caspien is an utter fraud. Where is the detailed financial accounting that was promised? How much did he pay himself, his wife, step sister and any other family members? His lawyers last name is also Walsh. Coincidence? How much money went to him?

Any investor that touches Caspien or his work would have to be certifiably insane.

This letter was purely an attempt to “lawyer up” and proves how pathetic he really is.

Read this, and tell me Caspien and his cronies aren't monstrous scumbags:

Q: What effect will the refunds, AG complaints and campaign for a class action suit have on finishing the
    game or securing funding?
A: This is one of our biggest challenges. We understand and appreciate that our community has concerns
and are actively listening and working to address these as best we can. As game developers, and as
important as these issues are, they distract us from doing what we do best, which is to make the game we
promised. These legal issues and threats poison the well for potential investors, publishers, and buyers
who might otherwise be interested in partnering with us.

No I do not. And that is the sad implication of allowing this to taint everyone in one broad stroke. When people would point and say "Hey we get it you don;t like CoE,move on" this was always the bigger issue. It didn't exist in a vacuum. The crap that Caspien pulled has an affect on other games, studios and the industry.

What’s really weird is how all “answers” are phrased in the royal “We” tense, every reply is “we” did this, “we” made mistakes, even after all of the many failures, he can’t bring himself to say, “I” made a mistake, “I” am responsible......must be one of his other 13 personalities which is to blame.......

Q: How many complaints have you received from the AG?
A: Several. We are answering each one as honestly and thoroughly as we can while still focusing the majority of our efforts on the future of Chronicles of Elyria.

Honestly. Sure. Just like this entire (da)FAQ

Also, "six or so former team members who offered to volunteer" and Jeromy Walsh is the only one working with code, yet still don't have anyone who can answer questions or moderate forums in a most basic sense or answer questions in Discord. Almost like he is hiding behind one way communication of his own narrative. I mean "they" are.

Imaginary volunteers so he can have someone to blame and throw under the bus still...

Oh yeah because 8 million dollars and 4 years later, after shutting it down and firing all the staff, he isn't just saying he and some volunteers are continuing development so he doesn't get sued into jail time. Right. Pathetic.

    It's over.

Admit it and take some ducking responsibility.

There is no way he is going to deliver on anything the kickstater promised or sold.

    Comically delusional.

I hope that absolute crap response isn't enough to stop legal action. What the hell is he going to deliver, lol nothing.

So what action is being taken is this it or will he be seeing some charges?

Indeed like I have always said...only back with money you don't mind flushing down the toilet, on the off chance it will lead to something decent.

Only thing I can say is the people persuing this court action are pathetic.  Anyone with a brain knows you cannot fund a MMORPG via Kickstarter.  So just getting involved in this suite is admitting you are a very stupid individual.  Your only obvious course of action is to learn from your mistake or sit back and hope that something actually comes of the game.

Legends of Aria & Shroud of the Avatar did. Whether or not they are good is another story but they are still playable up and running MMO's.

I agree that people who backed this game used questionable judgement. I doubt that they were all "very stupid" and "pathetic" people by default. Many of them were probably just looking for their dream game, and got wrapped up in unrealistic promises. That doesn't excuse Caspien and his cohorts from their role in things. There is blame to place on both sides. It remains to be seen whether or not the developers can and will be held accountable in civil or criminal court.

Live servers would imply no more wipes.

Not there yet as far as I know.

He kinda has to, because he is speaking for an official company, as such it as to be addressed in the sense "We as a company" regardless of who did what, and not in the "I as an Individual" because, again, he is speaking for a company, not himself.

Just one of those nuance things.

This proves how wish washy and inept the laws are surrounding gaming and gaming businesses.

If you or i had to go to court for whatever reason and just asked the judge to accept our word for it,you would be laughed at.Yet here we are and he claims the game is still in production, except not having to provide any ongoing proof.

We need more laws on these sketchy business setups but then again, the laws have for years been trying to offer up loopholes for businesses to operate in a sketchy manner with LLC's.

What i want to see is 100% full disclosure and full access to ANY information on the business operations. If any backer asks for information in writing and it is found he lied then he is liable.

It really is sad that he asks people to TRUST him yet offers NOTHING in return to show his respect to those supporting him.If Caspian or ANY of these crowd funded devs had nothing to hide ,they would offer up any and all information without any hesitation or excuses.

Stop backing these projects. Problem solved. Stop using kickstarter for these gaming company's. Problem solved. The earliest I will buy a game is when it is pre-order and has an actual launch date.

Serious question here: If he in fact made a good faith effort to complete the project and all his spending was above board, why the charade about still being in development and looking for an investor? Why not just open the books like he promised and let everyone see that he didn’t pay himself, wife, other relatives anything out of line?

How is he paying his lawyers if they have no money?

where did the old times went..

game company try and search investors for a game.. then the game gets developed.

with all these kickstarter shit and pre-alpha or pre-release packages, they are only focussing on the hype and addiction to the gamers.. in order to toss them money..

a game company without money or investors is not able to make a game.. or should not be able to..

kickstarters are the fckups of everything..

myself got scammed through buying early access games aswell.. and @ some point i made a decision to do not so any more.

i only by games that are released.

Ten Cent we need you! Surely Jeremey can sell the whole thing to them for tuppence and they can release Chronicles of Elyria Reborn! Also those volunteers that are "staying on" we might have to get a posse together and rescue them from the cult of Caspian. :)

Great time for another classic video by Living Colour.

Though Milli Vanilli might be more appropriate as they were always faking it too.   :D
