So I just fired my lawyer today.

    You did the right thing. Others in your situation would have chosen the quick money, however a long term job is the way to go.  Its like Columbus' voyage, he could go for gold, or set up trade relations with the "Asians".  Thanks for standing up for what our society should be like

    I am also in a similiar situation Enigma.  One of my last employers did not pay me for my last 2 weeks of employment so I took it to the Local Employee Rights Advocate.  I know its hard to say, but your employers are people too who go through rough spots.  I do want my money and if they didn't want to pay, they shouldn't have had me work 2 weeks, so I will fight for that money.  However, that employer is in transportation which has been hit rough this past year.  I know that he has no money and even if I did sue for "time", it wouldn't mean anything since he doesn't have the money to pay.  He is just an old man with a family to support and a failing business, while I easily recovered and found a new job in a day.

    One thing I have learned is that lawyers have little moral core, with greed and lies.  They will con and wrench money out of people's hand for the things they hold dear.  I don't trust a lawyer and never will.  Thier world is small.

    Enigma, if your employer is Verizon, then you need to hit them hard.  (ok maybe i have a little bad taste in my mouth from a previous job..lol)

    Honestly, the idea of them expecting you to come back to work after 2 days of breaking BOTH feet is beyond ridiculous.     I used to be in a sit down tech support role at Verizon and trust me just because you are sitting down does NOT mean you can do your job well, ESPECIALLY if you are doped up on meds.

     

    I think you SHOULD sue to get AT LEAST your back pay missed.  ...and like another poster said, this might not be about you but about protecting a future injured worker as well. 

    ...I share in your feelings of not wanting a frivolous lawsuit.  ..oh boy do I.  tough place to be.

    I put yes But Id only go for so mutch to make sure i could bargen down to a good Number.

    Id get my back pay and have them cover all Legal fees, then a grand or to Extra to pay to pain the house or something seeing as you got hurt on the job and wernt able to finish it your sellf

    But yeah if they paid for all the Med and it was a work place thing Id make them pay you while your off because of work Fudgeing up.

    But there is No reason to be greedy.

    If it is a mom and pop job then ill leave it in your court. Some can be Great. Others are crap.

    Leaving a Hole in the floor would never have been Ok when i was Installing networking cable. and was it a outside company that did it? if so they might be just as guilty if not more so than the company.

    I cannot stand frivolous lawsuits and I know if I took that amount to court, the Judge would have laughed my ass out of the courthouse.
    What do you all think? Would you have gone with the "punitive damages" or sue for the amount you are owed based on my situation only?



     

    Good Job. I applaud you. It takes one hell of a man to preach their morals and then follow through with them in such a case.

    To answer your question:  No I wouldn't have sued for extra money just what I was owed.

    I had a similar experience but not quite the same. While on duty some dipshit sucker punched me in the left ear, absolutely unprovoked.   It blew out my outer eardrum completely.  I smashed his skull wide open on a brick trash drop point.   Blood was everywhere.  Look just like someone died in the spot after it was over.  His skull was opened up bad bad enough that he was on bed watch for quite awhile.

    When I heard they were going to give this guy an article 15 (loss of pay and extra duty).  I went to my 1 Sgt and asked him not to dock the man's pay. It wasn't needed.  The mans wife and kids shouldn't have to pay for their dad's stupidity.

    He was utterly shocked by my request.  He told me why don't I go up to the Battalion Co.'s office knock on the door and tell him what I just said.   So I did.  I gained my 1 Sgt's unchangeable respect that day.  It felt fucking good. Not to mention I was never on his bad side ever again.  No matter what I did and I was a rowdy fuckin drunk. LoL.

      Detour alittle: sorry but I gotta.  This was freaking sweet!  I could have gotten into deep shit for this but didn't all because of my morals prior (above).

    Not to mention on the demo range there was an  80 series tank.  I wanted to make a diamond cutting charge and cut the barrel off.  1st Sgt and my Co wanted me to explain and show my caculations for how big it needed to be before they gave me the go ahead. 

      I was in charge of  the AHA ( forget how it is abrieviated: been awhile).  We needed to burn off alot of demo and it was about to get dark.  So I and a few others ended up laying a couple mines and about 200 pounds of C4 on and around / inbetween its track and road wheels.   Blew that mother and its track in about 200 yard radius. Almost had track fall in our safty area. LoL>>>  Needless to say,  They weren't happy about it after they saw the mess. 

    The tank's hull was upside down and deformed (badly).

    Track was scattered in about a 200 yard radius. (Not Good, safety  reasons)

    Turrut was upside down as well about 40 feet from the tanks hull.  (just pure wtf )  

    But he never once said a thing. I got my dam tank barrel as well. LoL>>>>  Stuck it in my HEMTT after being told not to by others.  Fuck'em! hahahaha.  Took it to his office and put it in a corner with a plaque. LoL!.   I would love to see what housing said about that when he tryed to take it with him.  I am sure he did too.     Some one video tapped the tank go up from inside a 113  that day.  He processed out before I could get a copy of the dam video.    Fucken sweet.  lol!

    Back on track.

    Six years later my eardrum grew back from 2 sides somewhat, Over lapped and never sealed. I live with a constant ringing 24/7. You know that loud buzz that your tv does when the stripped screen comes up. That's it. I don't regret my request for a single minute. I dam near killed the man in self defense. I think he learned his lesson.

      If you did what you say you did, your fucking awsome.  I would buy you a beer any day of the week any time.
